Terms of Service

Last updated: June 13, 2026

Draft pending legal review. A working draft prepared from ParkShare's product features; not yet final or counsel-approved, and not legal advice.

1. Acceptance & eligibility

By using ParkShare you agree to these Terms. You must be at least 18 and able to form a binding contract. If you use ParkShare on behalf of a business, you represent that you are authorized to bind it.

2. What ParkShare is

ParkShare is a marketplace that connects Sharers who make parking space available with Parkers who reserve it, typically near events. ParkShare does not own, operate, or control any parking space and is not a party to the agreement between a Sharer and a Parker. We provide the platform, payment processing (via Stripe), and related tools.

3. Accounts

Keep your credentials secure and your information accurate. You are responsible for activity on your account. We may require identity verification and may suspend accounts for violations, fraud, or risk.

4. Sharer terms

  • You represent that you own or have the legal right to rent the space you list, and that listing and renting it complies with all applicable laws, zoning, lease/HOA rules, and permit or licensing requirements in your area. You are solely responsible for confirming this and for any taxes on your earnings.
  • You set availability and pricing. When a Parker completes a reservation, you authorize the Parker to park in the listed space for the reserved time.
  • Payouts are made to you through Stripe Connect after a reservation completes. You must complete Stripe onboarding to receive payouts; until you do, payouts are held pending.
  • If a vehicle parks improperly or overstays, any towing must follow applicable law (in Nevada, NRS 487.038, including required notice). Wrongful towing is your responsibility.

5. Parker terms

  • Pay for reservations through the app. Park only in the space you reserved, for the time you reserved, and follow the Sharer's posted instructions.
  • You are responsible for your vehicle and for any damage you cause to the Sharer's property.

6. Payments & fees

Parkers pay the space price plus a service fee shown at checkout. ParkShare retains its fees; the remainder is paid to the Sharer on completion. All payments are processed by Stripe; by paying you also agree to Stripe's terms. Prices are in U.S. dollars.

7. Cancellations & refunds

Unless a listing states otherwise:

  • 24+ hours before the reservation start: full refund.
  • Within 24 hours of the start: refund of the space price; the service fee is non-refundable.
  • At or after the start (no-show): no refund.

Refunds are returned to your original payment method via Stripe.

8. Identity verification

We may require identity verification for some users or actions. Providing false information or failing verification may limit or end your access.

9. Disclaimers & limitation of liability

The platform is provided "as is." To the fullest extent permitted by law, ParkShare disclaims warranties and is not liable for the conduct of Sharers or Parkers, or for property damage, theft, injury, or loss arising from a parking arrangement between users. You are responsible for carrying any insurance you deem appropriate; a homeowner's or auto policy may not cover commercial use, and you should confirm your own coverage. To the extent ParkShare is liable, liability is limited to the fees you paid to ParkShare for the transaction at issue.

10. Indemnification

You agree to indemnify ParkShare against claims arising from your use of the service, your listings or bookings, or your violation of these Terms or applicable law.

11. Prohibited conduct

No unlawful, fraudulent, infringing, or unsafe use; no circumventing fees; no misrepresenting a space; no harassment of other users.

12. User content, reporting & objectionable-content policy

ParkShare lets users create content — messages, reviews and ratings, profile and space photos, and other postings ("User Content"). You are solely responsible for the User Content you submit, and you grant ParkShare a license to host and display it for the purpose of operating the service.

There is zero tolerance for objectionable content or abusive behavior. Prohibited User Content includes anything unlawful, harassing, hateful, threatening, defamatory, sexually explicit, or that infringes another's rights, as well as spam and impersonation.

Reporting and blocking. Every surface that carries User Content provides a way to report the content and to block the user responsible. You can report objectionable content or abusive users from within the app (for example, on a message, review, profile, or listing), and Sharers and Parkers can block and report one another. You may also email support@parkshare.app.

Our response. We review every report and act on objectionable-content and abuse reports within 24 hours — removing the content, and warning, suspending, or banning the responsible user as warranted. Ejecting an abusive user is at our sole discretion. Blocking a user prevents further interaction between you and that user, including new bookings.

13. Account deletion & data

You can delete your account in the app. We anonymize personal data but retain transaction and completed-reservation records as required for tax, accounting, and dispute purposes. See our Privacy Policy.

14. Governing law & disputes

These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-laws rules. Venue for disputes lies in Clark County, Nevada, unless a binding arbitration provision is added following legal review.

15. Changes & contact

We may update these Terms and will revise the date above; continued use means acceptance. Questions: support@parkshare.app.
